01 Acceptance of Terms
By accessing or using the OceaniQ website (oceaniq.co.in and associated subdomains), mobile application, or by placing any order — whether as a consumer, business, or trade partner — you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full.
If you do not agree with any part of these terms, you must discontinue use of our website and services immediately. These terms apply to all visitors, users, customers, and trade partners of OceaniQ.
By ticking "I agree" on any OceaniQ form, completing a purchase, or continuing to browse this website after this notice has been displayed, you are entering into a binding agreement with OceaniQ (Om Fish Suppliers, Pune, Maharashtra).
02 Our Services
OceaniQ provides the following services, each subject to these terms:
- B2C Home Delivery: Direct-to-consumer fresh and processed seafood delivery within Pune City.
- B2B & Wholesale Supply: Bulk orders for restaurants, hotels, cloud kitchens, caterers, and institutional buyers.
- Export Services: International shipment of seafood products to approved destinations, subject to applicable export regulations.
- Import Facilitation: Sourcing and import of premium international seafood varieties for Indian buyers.
- Subscription Plans: Recurring delivery arrangements for individual and business customers via the OceaniQ app.
OceaniQ reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.
03 Orders & Payments
All orders placed through our website, app, or via direct communication are subject to availability and confirmation by OceaniQ. An order is not confirmed until you receive a written or electronic acknowledgment from us.
- Prices listed on our website are inclusive of applicable taxes unless stated otherwise and are subject to change without notice.
- Payment is required in full at the time of order for B2C customers. B2B customers may be eligible for credit terms subject to a separate written agreement.
- Accepted payment methods include UPI, net banking, debit/credit cards, and bank transfers. International buyers may pay via wire transfer or approved trade payment instruments.
- OceaniQ is not liable for losses arising from unauthorised use of payment methods. Customers must notify us immediately of any suspected fraudulent transactions.
- Cancellations must be made within 15 minutes of order placement for B2C orders. B2B cancellation terms are governed by the applicable wholesale agreement.
Important: For perishable goods, once an order enters processing or dispatch, cancellations may not be accepted and refunds may be partial or unavailable.
04 Delivery & Shipping
OceaniQ maintains a cold-chain logistics network to ensure product freshness. Delivery timelines are estimates and may vary due to weather, logistics constraints, or force majeure events.
- Standard B2C deliveries are made within 24–48 hours of order confirmation, subject to your pincode being within our delivery area.
- OceaniQ is not responsible for delays caused by incorrect or incomplete delivery addresses provided by the customer.
- Risk of loss or damage to products transfers to the customer upon delivery.
- Delivery charges, if applicable, will be disclosed at checkout prior to order confirmation.
- For export shipments, delivery terms (FOB, CIF, etc.) are governed by the relevant trade agreement and Incoterms 2020.
05 Quality & Returns
OceaniQ is committed to delivering the highest quality seafood. Every batch undergoes quality inspection prior to dispatch. However, given the perishable nature of our products, the following terms apply:
- Claims regarding product quality, freshness, or incorrect items must be raised within 2 hours of delivery with photographic evidence sent to ompardeshi2004@gmail.com.
- Accepted quality claims will be resolved via replacement, credit note, or refund at OceaniQ's discretion.
- Returns of perishable goods are generally not accepted due to food safety regulations. Exceptions are made only for verified quality failures.
- Complaints relating to weight discrepancies must be supported by a photograph of the sealed product on a calibrated scale.
06 B2B & Wholesale Terms
Business customers, distributors, and wholesale partners are additionally bound by any separately executed Wholesale Agreement or Purchase Order terms. In the event of conflict, the specific agreement prevails.
- Minimum order quantities (MOQ) apply and will be communicated at onboarding. MOQ is generally 50 kg but varies by product category.
- Credit terms, if granted, are subject to credit assessment and may be revoked at OceaniQ's discretion in the event of default or payment delays.
- B2B customers must not resell OceaniQ products under a competing brand or use OceaniQ branding without written authorisation.
- OceaniQ reserves the right to audit purchase volumes and terminate partnerships found in breach of exclusivity or territorial agreements.
07 Export / Import Terms
All international trade conducted through OceaniQ is subject to the trade laws and regulations of India, including the Foreign Trade Policy, APEDA guidelines, and the laws of the destination country.
- The buyer is responsible for obtaining all necessary import licences, customs clearances, and compliance documentation in their country.
- OceaniQ holds all required certifications for seafood export from India. Copies of certifications are available upon request.
- OceaniQ is not liable for goods detained, seized, or rejected by customs authorities due to the buyer's failure to comply with import regulations.
- Export pricing is quoted in USD or INR as agreed. Exchange rate risk is borne by the buyer unless otherwise stated in the trade contract.
- Any trade sanctions, embargoes, or import bans applicable to the destination country are the buyer's responsibility to disclose prior to order.
08 Intellectual Property
All content on the OceaniQ website and app — including but not limited to the OceaniQ name, logo, product photography, written content, and design — is the exclusive property of OceaniQ (Om Fish Suppliers) and is protected under Indian copyright and trademark law.
- You may not reproduce, distribute, modify, or use OceaniQ content for commercial purposes without express written consent.
- Unauthorised use of the OceaniQ brand, logo, or trade name will be pursued under applicable intellectual property law.
- User-submitted content (reviews, photos, etc.) grants OceaniQ a non-exclusive, royalty-free licence to use such content for marketing purposes.
09 Privacy & Data
OceaniQ collects and processes personal data in accordance with applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDPA).
- We collect only the data necessary to process your orders, provide customer support, and improve our services.
- Your personal data will not be sold or transferred to third parties for marketing purposes without your explicit consent.
- We use industry-standard security measures to protect your data. However, no digital transmission is fully secure, and OceaniQ cannot guarantee absolute data security.
- You have the right to access, correct, or request deletion of your personal data by contacting us at ompardeshi2004@gmail.com.
- By using our website or app, you consent to the use of cookies and similar tracking technologies to enhance your experience. You may disable cookies in your browser settings.
10 Limitation of Liability
To the fullest extent permitted by law, OceaniQ's total liability to any customer or trade partner — whether in contract, tort, or otherwise — shall not exceed the value of the specific order giving rise to the claim.
- OceaniQ is not liable for indirect, consequential, incidental, or punitive damages arising from use of our services.
- OceaniQ is not responsible for losses arising from events beyond our reasonable control, including but not limited to natural disasters, government actions, port closures, or pandemics.
- Nothing in these terms limits OceaniQ's liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11 Changes to Terms
OceaniQ reserves the right to update or modify these Terms & Conditions at any time. Updated terms will be posted on this page with a revised "Last Updated" date. Where changes are material, we will provide at least 14 days' notice via our website or registered email.
Continued use of OceaniQ services after any changes constitutes acceptance of the revised terms.
